Living in Malta with bitcoin: taxes, residency and practical guide for 2026

Ilustración editorial para la guía sobre bitcoin, impuestos y residencia en Malta.

This guide is part of the comparison of the 10 best countries to live with assets in bitcoin. Before making a sale, it is also a good idea to review how to change tax residence before selling bitcoin.

Quick verdict

Malta can offer a result of 0% on a true private capital gain in bitcoin, because their tax guidelines treat BTC as a coin comparable to fiat currency and coins do not form part of the listed assets subject to Maltese capital gains tax. But there is no magic deadline that guarantees exemption: if the facts reveal trading, inventory or a business activity, the profit goes to ordinary income and can be taxed up to 35%.

The country occupies seventh place in the ranking for three reasons. It belongs to the EU, does not apply a general wealth tax and has a regulated framework for crypto services. In exchange, its main tax criterion on DLT dates back to 2018, does not well resolve DeFi, staking or the location of BTC in self-custody, and requires coordinating capital against business with residence, domicile and remittances.

Malta is more interesting for a patient holder, with few operations and real life on the island, than for a frequent trader looking for an automatic quantitative rule.

Who it fits — and who it doesn’t

You may fit if:

  • BTC were purchased as savings or store of value and have been held for years;
  • there will be one or a few sales, without leverage, robots or business organization;
  • you wish to reside within the EU and the island cost is accepted;
  • There is a complete history of purchases, wallets and own movements;
  • A Maltese tax opinion can be obtained before a material transaction.

It is not the safest option if:

  • one buys and sells daily or lives systematically from these operations;
  • BTC belong to a company, fund, trust or business;
  • custody, intermediation, advice or management is provided to third parties;
  • The profitability comes from lending, wrapped BTC or products called “bitcoin staking”;
  • The aim is to obtain a residence card without actually moving housing and living facilities.

Bitcoin tax table in Malta

Situation Prudent treatment in 2026
Hold BTC It does not generate income on its own nor is there a general annual wealth tax
Private sale of a coin held as capital The gain falls outside the list of assessed capital gains; possible 0%
Sale or exchange in the course of trading Ordinary income, with a progressive personal rate of up to 35%
BTC used to pay or exchanged for another crypto It is a disposal; the result depends on whether it remains private capital or is part of an activity
Mining The reward or benefit from the activity is treated as income; can be business
Staking, lending or yield Without sufficient modern official guidance; separate reward, service and subsequent sale and ask for judgment
Net worth No general tax on BTC balance
VAT The analysis depends on the operation and whether a service is provided; mere investment is not equivalent to subject activity

The central rule: “coin” does not mean “everything crypto”

The DLT Assets – Income Tax Guidelines from the Maltese administration divide DLT-based assets into coins and tokens. A coin functions mainly as a means of payment, unit of account or reserve of value and does not incorporate the characteristics of a security or a project. BTC naturally fits into that category.

For income tax, the guidance indicates that the treatment of a coin follows that of fiat currency. The profit derived from exchanging coins in the course of a business is treated as income; On the contrary, coins do not enter the catalog of assets whose transmission generates a subject capital gain.

This architecture produces the possible 0%, but imposes two checks:

  1. The asset must actually be a coin. A token that grants participation, financial right or access to a project may be treated differently.
  2. The gain must be capital. Calling yourself an “investor” does not prevent frequency, intention, financing, organization or connection with other businesses from revealing a commercial activity.

There is no equivalent in Malta to the German year or the Portuguese 365 days. Holding BTC for five years helps prove investment intent, but does not by itself create a legal exemption. Likewise, selling after three months does not automatically obligate you to pay taxes if exceptional events demonstrate an investment; it just makes the position more difficult.

Private equity vs. trading

The distinction is studied with the set of circumstances. For a relevant position it is advisable to document:

  • the original intention when purchasing;
  • the duration and stability of the portfolio;
  • the number of operations and the proportion of assets sold;
  • the use or absence of outside financing;
  • whether there is staff, software, office, business accounting or advertising;
  • if the person lives off repeat sales;
  • if the BTC appears as inventory of another activity;
  • the reason for an extraordinary liquidation.

A single sale does not guarantee capital and a hundred operations do not by themselves create a company, but both are strong indications in opposite directions. When there is activity, the 2026 personal rates reach 35% for the upper part of taxable income.

Example: same capital gain, two results

A person buys BTC for 50,000 euros with personal savings, keeps them for five years and sells them for 500,000 euros after becoming a real resident in Malta. If the transaction is accepted as a realization of a coin held as capital, the €450,000 gain is not part of the assets subject to Maltese capital gains tax.

Another person buys and sells every week, uses credit, automates orders and gets the money they live on. Even if an isolated transaction also shows a difference of 450,000 euros, the administration can treat the result as trading profit and apply ordinary tax. The example does not calculate deductions or other income; shows why the percentage depends on the ranking, not just the token.

Swaps and payments with BTC

Exchanging BTC for euros, stablecoins, ether, a property or a service is an economic arrangement. In a strictly private portfolio, the profit on the coin can remain outside the capital gains catalog. In a commercial activity, the market value received is part of the business result.

Using BTC daily for a living adds numerous valuations and records and can complicate the “passive reserve” story. It does not necessarily transform all assets into trading, but it requires identifying units, cost and value in each payment. For large monetization, a traceable sale through a regulated supplier is usually more defensible than hundreds of consumptions without a consistent book.

A crypto-crypto exchange should not be treated as a movement between own wallets. Transferring BTC between two addresses controlled by the same person is not a sale; exchanging it for another asset is.

Mining and the false “bitcoin staking”

Bitcoin works through proof of work and has no native staking. Commercial products called “BTC staking” typically involve lending, custody, wrapped BTC, a third-party protocol, or a promise of yield. Your tax and legal risk is different from that of holding BTC.

The Maltese guide considers mining an income-generating activity. The reward must be assessed when it is obtained, the admissible expenses and the subsequent disposition of the BTC. If there is an organized farm, clients or provision of computing power, business and VAT analysis is inevitable.

No sufficiently concrete official Maltese guide has been found for modern staking, lending, liquidity pools or liquid staking tokens. A reasonable position is to separate:

  1. the yield or token received;
  2. the eventual service provided;
  3. the exchange of the deposited asset;
  4. the subsequent sale of each reward.

For material amounts, written confirmation must be obtained. It is not responsible to extrapolate 0% of an equity coin to a periodic stream of returns.

Residence, domicile and remittances

Malta does not use a single word to decide the tax scope. Residence, ordinary residence and domicile matter.

The maltese tax administration explains that a presence of more than 183 days creates tax residence for the year. Whoever arrives with the intention of establishing residence can be a resident from the date of arrival even without reaching that number. Residency is a matter of fact and can coexist with that of another country until an agreement resolves the conflict.

An ordinarily resident and domiciled person is taxed on worldwide income and profits. Who is a resident but not domiciled usually applies the remittance base:

  • Maltese source income: taxed even if it remains outside;
  • foreign income: taxed to the extent received in Malta;
  • foreign capital gain: not taxed even if it is remitted.

The official guide on the remittance basis adds a caution: certain people under this system and with at least 35,000 euros of unremitted foreign income can support a minimum annual tax of 5,000 euros. There are exceptions and special regimes, and the test of whether a bank income is income or capital lies in traceability.

For BTC there is an additional difficulty: the DLT guide does not define in a modern way the situs of a key in self-custody, multisig or distributed custody. That is why the entire strategy should not be based on affirming without support that the profit is “foreign.” The cleanest argument for private BTC is first its status as an equity coin; The remittance base is a second layer that requires analyzing the source.

Residence routes

A citizen of the EU, EEA or Switzerland can reside in Malta under free movement. If you remain economically self-sufficient for more than three months, you must register your presence, prove sufficient resources and comprehensive medical insurance. Identità publishes the documents and the procedure.

For third country nationals there is no equivalent generic door. Economically self-sufficient residency is usually linked to local residency or tax programs such as the Global Residence Programme, Malta Retirement Programme, or Malta Permanent Residence Programme. The official Identità information requires reviewing the chosen program, insurance, housing, family and renewals.

The Global Residence Program applies, among other conditions, 15% on foreign income remitted and a minimum annual tax of 15,000 euros. It does not convert a crypto business into exempt profit nor does it replace proof of source. The nomadic permit requires actual remote work for foreign entities or clients; It should not be used as a rentier visa if there is only one portfolio.

In all cases, immigration permit and tax residence are different tests. A person who maintains a home, family and economic center in Spain can continue to be a Spanish resident even if they have a Maltese card.

Banks, exchanges and origin of funds

MiCA is applicable in the EU from the end of 2024. The Malta Financial Services Authority oversees authorized providers under the Markets in Crypto-Assets Act and publishes rules on custody, governance and customer protection.

That improves the framework, it does not guarantee that a bank will accept any transfer. Before selling a large amount, it is advisable to present to the supplier and the bank:

  • statements used for initial purchases;
  • Full exchange CSVs;
  • own addresses and on-chain transactions;
  • explanation of movements between wallets;
  • historical tax returns;
  • proof of residence and acquisition cost;
  • chain analysis report when the history is complex.

The seed phrase or a private key is never given. Control can be demonstrated with an agreed-upon cryptographic signature or microtransaction.

From 2026, DAC8 obliges EU reporting providers to collect and report user transactions. A correctly declared result of 0% is still 0%; what disappears is the expectation of opacity.

Relevant changes between 2023 and 2026

  • The Maltese substantive DLT rules have not been modernized – the core guidance remains as of November 2018.
  • MiCA began to be applied to the sector and Malta implemented its CASP authorization from the end of 2024 and during 2025-2026.
  • DAC8 became operational on January 1, 2026 for information on cryptoassets.
  • The 2026 personal rates maintain the 35% maximum, relevant if the gain is reclassified as income.

The stability of the possible 0% is positive; The lack of specific doctrine on self-custody, DeFi and staking is a weakness that must be reflected in any planning.

Checklist before selling

  1. Confirm that the asset is direct BTC and not a token, ETF or claim on a custodian.
  2. Prepare a timeline that demonstrates investment intent and low frequency.
  3. Validly leave the residence of the previous country before any exchange.
  4. Obtain registration and Maltese tax certificate where applicable.
  5. Determine domicile, ordinary residence and global or remittance base.
  6. Request opinion on capital versus trading and, if used, on foreign source.
  7. Separate investment, spending and any activity wallets.
  8. Prevalidate the origin of funds with CASP and bank.
  9. Record value, units, time, commissions and counterparty of the sale.
  10. Declare the operation or information required even if the fee is zero.

Risks that can destroy the result

  • sell or convert to stablecoin before leaving previous residence;
  • call a common trading system capital;
  • mix own assets with client funds;
  • assume that every token is treated as BTC;
  • consider a key in self-custody as foreign without criteria regarding its location;
  • remit funds without being able to distinguish income from capital;
  • believe that the residency program alone sets the tax treatment;
  • confuse absence of property tax with absence of VAT, licenses or reporting.

Conclusion

Malta can be an excellent tax home for truly privately held old BTC. Its strength is not a law that says “bitcoin pays zero”, but the combination of two principles: BTC works as a coin and the profit on that coin, if it is capital, does not appear among the assessed capital gains.

That same architecture explains its weakness. There is no certain deadline and the result depends on facts, address, source and remittances. For a major sale, the prudent decision is to obtain a prior Maltese opinion and another from the country of departure. If the taxpayer wants a mechanical rule, Germany or Portugal are easier; If you agree to document a capital position and want life within the EU, Malta deserves its seventh place.
