How to change tax residence before selling bitcoin: legal and documentary guide for 2026

Impuesto y Bitcoin

Moving to a country that does not tax the sale of bitcoin is not enough. For the tax result to be defensible, three things must coincide: having ceased to be a resident of the country of origin, having actually become a resident of the destination country and selling when the conditions of the local exemption are already met.

The order matters. If the sale, exchange or payment with bitcoin occurs before completing the tax move, the country of departure can tax the capital gain even if the money later arrives at a foreign bank. Using an account from another country, a foreign exchange or a self-custody wallet does not change the result either: what usually decides which State can collect is the tax residence of the person when the income is made.

This guide uses Spain as the main example of departure for the audience to which the series is directed. It does not replace the analysis of the country of origin of each reader.

To choose the destination, consult the comparison of the 10 best countries to live with assets in bitcoin.

Residence permit and tax residence are not the same

A visa, a residence card, a company or a home allow you to live or work in a country. They do not prove on their own that taxes have stopped in another.

Planning needs to pass two different tests:

  1. Entry test: comply with the tax residency law of the new country and, where possible, obtain a tax certificate.
  2. Output test: stop meeting the residency criteria of the previous country and resolve any dual residency through the applicable agreement.

The prudent route for a significant estate is to spend at least 183 days in the destination during the first full year, moving housing and family life there, reducing residential ties to the previous country, and documenting each step. Some destinations allow you to be a resident for fewer days, but a domestic rule of 60 or 90 days may be insufficient in the face of the agreement or an inspection in the country of departure.

The Spanish case: the three criteria that must be broken

The Tax Agency considers anyone who is in any of these situations to be a resident in Spain:

  • stays more than 183 days during the calendar year, initially counting sporadic absences;
  • maintains the main core or base of its economic activities or interests in Spain, directly or indirectly;
  • or, unless proven otherwise, has a non-legally separated spouse and dependent minor children in Spain.

Spanish residency is determined for the entire calendar year: the change does not automatically divide the year into a resident and a non-resident part. This is how she explains it herself Tax Agency in its guide on residence of natural persons.

Therefore, accumulating 184 days outside Spain does not in itself guarantee departure. If the permanent home, the family, the management of the companies and the main source of income continue in Spain, the Spanish tax authorities may dispute that the centre of interests has moved.

When both countries consider the same person a resident, the agreement must be read to avoid double taxation. The tie-breaking criteria usually examine, in this or a similar order, permanent residence, center of vital interests, place of habitual living and nationality. The specific text of the agreement rules.

When to sell

The conservative sequence is as follows:

1. Before the move: inventory and diagnosis

It is advisable to rebuild before leaving:

  • date and cost of each BTC acquisition;
  • commissions and bank transfers used to purchase;
  • exchanges, accounts, wallets and own addresses;
  • exchanges between cryptoassets already carried out;
  • mining rewards, staking, lending or payments collected in crypto;
  • donations, inheritances or transfers between family members;
  • outstanding losses and information returns filed;
  • nationalities, former residences and controlled companies.

In Spain, both the sale for fiat currency and the exchange of one cryptocurrency for another can produce a capital gain or loss. The guide from the Tax Agency on the sale and exchange of virtual currencies confirms both taxable events. Converting BTC to a stablecoin before exiting is therefore not a neutral pause under the Spanish rule.

2. Year of the move: moving your life, not just your home

The file should show a coherent story:

  • deregistration or change of residence in the country of origin;
  • housing available continuously in destination;
  • entrances, exits and calendar of days;
  • transfer of spouse and children when appropriate;
  • schooling, health insurance, telephone, supplies and daily activities;
  • tax registration, local identifier and declarations at destination;
  • accounts and means of payment used for ordinary life;
  • transfer of effective business management, if they exist;
  • census communications at origin.

Changing your address on a form is useful evidence, not a tax move in and of itself.

3. Obtain evidence of residence at destination

The tax residence certificate, immigration history and local declaration are especially valuable pieces. It must be verified that the certificate is valid for the corresponding agreement; Some States distinguish the domestic certificate from that issued for treaties.

4. Wait for the specific exemption to be fulfilled

Not all 0% regimes work the same. Germany and Portugal require, for the ordinary case of the private investor, a holding period. Switzerland, Singapore, Malta or Malaysia distinguish investment from commercial activity. Emirates separates personal investment from a business. El Salvador retains a specific exemption for bitcoin exchanges. Each article in this series explains its rule.

5. Sell with a prepared compliance file

Before sending a large amount to an exchange or bank, it is advisable to review the source of funds in advance. The entity may request more information than the tax return requires. Having 0% tax does not eliminate anti-money laundering rules.

The bitcoin fund origin file

A good file allows you to connect legal money, purchase, custody, sale and bank entry. It should contain, at a minimum:

  • bank statements of initial purchases;
  • CSV histories and exchange statements;
  • transaction identifiers and blockchain addresses;
  • proof of wallet control, without revealing the seed or private keys;
  • book of movements between own wallets to avoid treating them as sales;
  • assessment criterion and unit identification method;
  • historical tax returns and proof of taxes paid;
  • contracts or invoices if the BTC was received for work;
  • inheritance or donation documents and entry valuation;
  • chronological report prepared by a specialist when the history is complex.

A screenshot of the current balance does not demonstrate how it was obtained. For old assets, the combination of on-chain movements, exchange emails, bank statements and previous statements can reconstruct a sufficient chain of evidence.

Private keys and seed phrases should not be given to banks, advisors or authorities. Proof of control can be done through signed messages, microtransactions or other agreed procedures without compromising custody.

Five risks that often invalidate the 0% assumption

Sell before finishing the exit

The fact of withdrawing the euros months later does not move the date of the gain. The relevant thing is usually the sale or exchange. A loan with BTC as collateral has a different analysis, but can be liquidated or generate other income and should not be used as an improvised substitute for a sale.

Preserve the real center of life in the previous country

An available home, family, running a company and most of the time can outweigh a foreign residence card.

Confusing investment with economic activity

Frequency, organization, external financing, promotion to third parties, automation and provision of services can turn the investor into a trader or entrepreneur. In that case, the private gains exemption disappears in several of the best-placed countries.

Using a company without analyzing it

A company does not automatically inherit the 0% expected for an individual. It can support corporate tax, international tax transparency rules, transfer pricing, substance or permanent establishment. If management continues from Spain, it can also be discussed where the entity actually resides.

Come back too soon

Some countries recover gains made during a temporary absence. The United Kingdom, for example, can subject profits from the period of temporary non-residence to tax in the year of return, depending on the HMRC handbook. The intention to return and the period of absence should be reviewed before selling.

Spanish nationality and non-cooperative jurisdictions

Spanish nationals who prove a new residence in a non-cooperative jurisdiction can continue to be personal income tax taxpayers during the year of the change and the following four. The Tax Agency summarizes this rule of article 8.2 of the Personal Income Tax Law.

The list may change. As of August 9, 2026, the consolidated text of the Order HFP/115/2023, modified in June 2026. This check is mandatory before choosing a low-tax destination; It is not enough to use a list published years ago.

Is there an exit tax on bitcoin in Spain?

Article 95 bis of the Personal Income Tax Law regulates an exit tax on latent capital gains of shares or participations in entities when, among other conditions, value thresholds are met. The consolidated text of Law 35/2006 sets the joint threshold of 4 million euros and another assumption for participations of at least 25% whose value exceeds 1 million.

Direct ownership of BTC is not listed in that article as a share or participation. However, if the bitcoins are within a company and the person owns their shares, the analysis may change completely. There may also be regularizations, property taxes and pending obligations without there being an exit tax on direct BTC.

Fiscal transparency from 2026

The argument that operations will not be visible is increasingly unrealistic. In the European Union, DAC8 applies from January 1, 2026 and obliges reporting providers to collect transaction information from resident users; the European Commission explains the calendar and scope.

At the international level, the OECD Crypto-Asset Reporting Framework foresees annual automatic exchanges of information and the first exchanges by pioneering countries in 2027. OECD describes CARF and implementation dates.

These frameworks do not make a profit that the law exempts taxable. They do make it more important to correctly declare residence, tax identifier and operations.

The American exception

The series takes as its base case a person who is not a citizen or permanent resident of the United States. US citizens and, in general, US tax residents must declare worldwide income even if they live abroad; confirms it IRS in its guide for citizens and residents abroad. Moving to a 0% country does not by itself eliminate the federal tax, and an expatriation may have its own exit tax.

Prudent twelve-month calendar

Moment main action Evidence to preserve
3–6 months before Residence diagnosis, BTC inventory and simulation at origin/destination Reports, CSV, statements, wallet map
before leaving Housing, visa, insurance and family plan in destination Contracts, applications and supporting documents
moving day Start of housing and effective presence Travel tickets, border records, the housing contract and utility bills
First 90 days Immigration, tax, banking and ordinary life registrations Cards, local NIF, invoices and movements
During the year Daily control of presence and transfer of the vital center Calendar, passports, local activity
Upon completion of residency Request for tax certificate and review of the agreement Local certificate and declaration
Before selling Written confirmation of treatment and prior notice of source of funds Tax memorandum and KYC file
Sale and collection Traceable operation and value/commission registration Exchange confirmation and bank statement
Next year Declarations of origin and destination and response to requirements Declarations, certificates and complete file

Conclusion

The legal strategy is not to hide bitcoins or buy a paper residence. It consists of changing your life and residence before making the gain, applying the exact standard of the new country and being able to demonstrate the complete history of the assets.

For a relevant sale, it is advisable to obtain two coordinated opinions: one from the country of departure and the other from the destination. The second confirms the 0% or reduced rate; The first confirms that the old State can no longer tax the operation. Without both, the most attractive data in the ranking may be useless.

Warning: general information content. Residence, agreement, nationality, activity and origin of BTC may alter the result. It does not constitute tax, legal, immigration or investment advice.
