Living in El Salvador with bitcoin in 2026: taxes, residency and exemption limits

Ilustración editorial para la guía sobre bitcoin, impuestos y residencia en El Salvador.

El Salvador retains a unique advantage: the current Article 5 declares that Bitcoin exchanges are not subject to capital gains taxes. For BTC held as an investment and a sale qualifying as capital gains, the result can be 0%.

The mandatory 2021 model no longer applies. Private acceptance is voluntary, the State pays in the contracted currency and the payment of taxes in BTC was repealed. Bitcoin is still denominated legal tender, but its public role is minor. It ranks ninth because business trading, mining, yields and other crypto assets require different foundations, while banking and immigration add friction.

This guide is part of the comparison of the 10 best countries to live with assets in bitcoin. Before executing a sale, it is also advisable to review how to change tax residence before selling bitcoin.

Verdict

It fits the holder who will actually live in Central America, sells own BTC occasionally and accepts more operational risk. The strong case is capital gains, not a trading or mining company. The Digital Asset Issuance Law offers broader benefits, but only within its scope; its article 36 is not a universal safe conduct.

Ideal profile

  • Own BTC holder, traceable and maintained as an investment.
  • Person willing to overcome the tax threshold and build a real life.
  • Investor converting to USD with registered provider and pre-notified bank.
  • Entrepreneur, rentier or large net worth with a valid immigration route.

Unsuitable profile

  • Trader who calls all business profits «capital.»
  • Miner, lender or altcoin holder who extrapolates the Bitcoin Law.
  • Person who maintains a home and vital center in the country of departure.
  • Applicant treating the Freedom Passport as a recoverable investment.

bitcoin tax table

Activity Prudent treatment as of August 9, 2026 Decisive nuance
Hold BTC There is no tax for mere possession or unrealized capital gains Maintaining traceability and procurement value remains essential
Occasional BTC/fiat sale 0% on capital gain by article 5 of the Bitcoin Law It must really be capital gain; the law does not define all possible «exchanges»
Swap BTC/other crypto asset Result not sufficiently clarified in a public tax guide Don’t assume any complex swap is the same assumption as BTC/USD
Payment for goods or services with BTC Private acceptance is voluntary; Article 5 provides an argument for the capital gain of the BTC delivered VAT, real estate transfer or other purchase taxes do not disappear; LEAD excludes certain payments from your benefits
Regular trading Ordinary business income risk, with a personal scale that reaches 30% Article 5 names capital gains, not all income; Article 36 of the LEAD only helps if the operation really falls within its scope
Mining The subsequent sale of BTC may generate exempt capital gains; reward, service and mining business do not have express exemption in the Bitcoin Law Analyze income upon receipt, local activity, energy, VAT and business form
Staking, lending or yield Bitcoin has no native staking; There is no general rule that guarantees 0% The LEAD can protect returns from covered assets, but the asset, operation and condition of the acquirer must be proven
Wealth A general periodic tax on net worth or personal wallet has not been identified Taxes on non-exempt income, real estate, transfers, consumption and municipal activity persist

The exemption that survived 2025

The Legislative Decree No. 199, published in the Official Gazette No. 21 of January 30, 2025, did not eliminate the benefit: it rewrote article 5 like this. Its article 8 ordered that the reform enter into force ninety days after that publication:

Trades in Bitcoin will not be subject to capital gains taxes.

The key word is capital. Article 14 of the Income Tax Law reserves this category for those who do not regularly negotiate goods. Ordinary article 42 applies 10% after twelve months and adds the previous gain to ordinary income; Special Article 5 displaces that tax for BTC, but does not say that it converts a regular business into capital. An isolated sale is the safest case; An organized table requires criteria regarding frequency, financing and instruments.

What changed in legal tender status

Bitcoin remains regulated as legal tender, but new Article 1 makes volunteer acceptance by totally private natural or legal persons. The State pays its obligations in the contracted currencies and articles 4, 8 and 9 were repealed, including the one that allowed taxes to be paid in BTC. Therefore, it is still legal tender, but there is no general mandatory private acceptance either. Tax article 5 continues.

Sale, swap and payment with BTC

BTC/USD via identified provider is the most defensible application. Cost, value, counterparty, commission and hash must be saved even if the result is zero. The text does not define every DeFi swap, bridge, wrapped token, or settlement.

When paying for a house or car, BTC can invoke article 5, but the purchase retains VAT, taxes or real estate transfer. In addition, article 36.e of the Digital Asset Issuance Law withdraws the benefits of that law for exchanges for goods or services outside its article 19. It does not automatically delete article 5, but it prevents mixing both regimes.

The Digital Asset Issuance Law is not a universal exemption

The consolidated LEAD mainly regulates public offerings, issuers, suppliers and participants. Its article 4 excludes assets that are legal tender in terms of monetary regulation and use for goods and services, with technical exceptions.

Within its scope, Article 36 exempts value, returns, income, capital gains and ordinary income by transfer; It also benefits acquirers, as confirmed by the CNAD. First it must be proven that the asset, operation and person fall into the LEAD. For a simple BTC sale, the clean basis is item 5; For a foreign altcoin without a regulated offer or participant, the same result should not be promised.

Trading, mining and returns

The Income Law taxes business activity and the personal scale reaches 30%. If trading is a business, it will be necessary to demonstrate that Article 5 or an applicable LEAD eliminates that income.

In mining, reward and sale are different moments. The Bitcoin Law protects the capital gains of the exchange better than electricity, hash power or business profit; A farm also reviews energy, VAT and payroll. Bitcoin does not have native staking: representative tokens and loans only enjoy Article 36 if the contract, asset and participant enter the LEAD.

Assets and other charges

There is no general periodic tax on net worth or annual fee on the wallet; Unrealized revaluation is also not capital gain. Yes, there are non-exempt income, VAT, real estate liens, municipal taxes and corporate obligations.

Relevant changes between 2023 and 2026

  • 2023: came into force and the LEAD was reformed, the CNAD was born and the registration of participants began.
  • December 2023: Adopting El Salvador announced long-term residency and citizenship for up to 1,000 annual investors with USD 1 million in BTC or USD.
  • April 30, 2025: The reform came into force that made acceptance voluntary, withdrew the payment of taxes in BTC and preserved the exemption.
  • 2025-2026: AML records and standards increased traceability. The court did not find a subsequent reform that eliminated article 5.

Tax residence and source of income

The system is mainly territorial: article 15 of world income is repealed and article 16 connects goods, activities, capital or services with El Salvador, although there are special rules.

The Tax Code treats a person as domiciled if they reside for more than 200 consecutive days in a calendar year or have their principal place of business there. After more than a year domiciled, you can be absent for up to 165 days without losing your status. The immigration card does not replace this proof. The conservative route is to get over the threshold, register and request a domicile certificate. An agreement, including that of Spain, can resolve dual residence per household and center of interests.

Migratory routes

Ordinary temporary residences

The Immigration Directorate offers categories of investor, business, rentier, pensioner, shareholder, merchant, work and family. Each form requires its own tests; owning BTC is no ordinary category. Requirements, apostilles, background and work authorization must be confirmed when applying.

Freedom Passport

The official page Living in El Salvador announces up to 1,000 places per year, threshold of USD 1 million in BTC or USD and inclusion of families with minor children. The money is allocated to development and social programs: it should be treated as a contribution, not a recoverable asset. There is selection, due diligence and conditions; Current terms are required before transferring.

Banking, cash-out and KYC

The USD facilitates settlement, but the bank can review or reject it. The public banking guide includes passport, NIT, declaration or proof of income and origin of funds according to risk. You should check the Bitcoin registry of the Central Bank or the CNAD digital asset registry depending on service and scope.

Before selling:

  • notify the supplier and the bank in advance of the amount, asset and route;
  • deliver purchase history, CSV, hashes and self-custody map;
  • prove the original money with statements, payroll, sale of company or inheritance;
  • separate BTC purchased, mined, received for services or donated;
  • Avoid opaque P2P, mixers and splitting to avoid alerts.

Registration does not guarantee solvency nor does it obligate the bank to accept the payment; The waiver is not a substitute for AML.

Prudent Examples

Occasional sale after a real move

Laura bought BTC for USD 80,000 in 2017 and, after establishing Salvadoran tax domicile, sells a portion for USD 600,000. If the transaction is a capital gain derived from an exchange in Bitcoin, Article 5 leaves it outside the capital gains tax. You must demonstrate that your previous country no longer taxes you and declare or report if a formal obligation requires it.

Trader with organized activity

Miguel operates daily with bots, derivatives and financing. You cannot conclude that Article 5 eliminates all of your income because your conduct may be habitual and businesslike. Article 36 could be relevant to assets and operations within the LEAD, but you must prove that connection. Without special coverage, the ordinary personal scale reaches 30%.

Buying property with BTC

Sara agrees with a private seller to pay for a house in BTC. Acceptance is voluntary and legally possible for the individual, but the real estate operation maintains deeds, registration, taxes and KYC. Article 36 of the LEAD does not, by itself, protect an exchange for an ordinary good; The treatment of BTC capital gains must be supported and documented separately under the Bitcoin Law.

Checklist

  • Confirm that the operation is an exchange in Bitcoin and a capital gain.
  • Separate BTC from altcoins, offering tokens and derivatives.
  • Obtain local criteria for regular trading, mining or material returns.
  • Overcome and document more than 200 consecutive days if the ordinary domicile route is used.
  • Correctly extinguish the residence of the previous country.
  • Choose immigration category based on real facts, not crypto advertising.
  • Treat the USD 1 million of the Freedom Passport as a non-recoverable disbursement unless a document states otherwise.
  • Obtain NIT and tax domicile certificate.
  • Verify provider in BCR or CNAD and scope of registration.
  • Prevalidate bank, limits and documents before selling.
  • Prepare source of funds, source of wealth and on-chain traceability.
  • Model underlying purchase taxes if a good is paid for with BTC.

Main risks

  1. Reclassification as ordinary income: Article 5 exempts capital gains, it does not mention all business profits.
  2. LEAD extrapolation: Article 36 is broad only after coming within the ambit of the law.
  3. Swap or complex product: There is no public tax guide that closes all cases.
  4. Policy change: The 2025 reform showed that the institutional model can change quickly, although it preserved the exemption.
  5. Cash out: Favorable regulation does not equate to automatic bank acceptance.
  6. Previous residence: A Salvadoran card or passport does not eliminate dual residency.
  7. Immigration cost: The Freedom Passport requires a much higher contribution than ordinary routes.
  8. Institutional and personal risk: Security, services, location and regulatory stability must be evaluated with visits and current advice, not only for tax savings.

Conclusion

Article 5 maintains one of the clearest exemptions on the continent for capital gains on BTC. An occasional holder, really moved, traceable and banked has a direct basis for 0%. Trading, mining, yield and altcoins come out of that core and explain the ninth place: great tax benefit, but more legal, banking and institutional caution than in the first destinations.
