Georgia is in fourth place because it combines moderate cost and a very favorable official rule. Since 2019, the Ministry of Finance considers that the income of a natural person from supplying a crypto asset is not of Georgian source and is exempt; Conversion to national or foreign currency is also exempt from VAT. The criterion does not convert bitcoin into legal tender nor automatically resolve derivatives, lending, staking or services to third parties.
This guide is part of the comparison of the 10 best countries to live with assets in bitcoin. Before executing a sale, it is also advisable to review how to change tax residence before selling bitcoin.
Verdict
Georgia is one of the best jurisdictions for a holder to actually move and sell BTC directly for euros, dollars or lari. The Public Opinion No. 201 provides a concrete basis. It is fourth due to banking friction, a smaller network of agreements and the need to separately analyze swaps, returns, business mining and third-party services.
Ideal profile
- Natural person with their own BTC, traceability and sale to fiat currency.
- Holder willing to stay 183 days and move on to his ordinary life.
- Citizen with a stay of up to one year without a visa, like the Spanish.
- Investor willing to use registered VASP and prepare banking KYC.
Unsuitable profile
- Who actually continues to live in their previous country and travels only to sell.
- User who intends to pay expenses directly in BTC, an operation normally prohibited.
- Derivatives or DeFi trader who needs certainty about every reward.
- Manager of other people’s money or holder without proof of cost and origin of funds.
bitcoin tax table
| Activity | Prudent treatment as of August 9, 2026 | Limit that should not be ignored |
|---|---|---|
| Hold BTC | No tax for mere possession or latent capital gains | Cost, history and proof of control must be kept |
| Occasional BTC/fiat sale | Exempt from income tax for the natural person under Opinion 201; VAT exempt exchange | The safest assumption is the supply of cryptoasset in exchange for national or foreign currency |
| Swap BTC/other token | There is no official conclusion as express as for BTC/fiat | Do not automatically transfer the VAT exemption described for fiat to all swaps |
| Payment with BTC | It should not be considered as an ordinary legal operation | The National Bank prohibits payments with virtual assets except for necessary exceptions for VASP services |
| Own spot trading | The text does not establish a holding period or maximum number of sales; There is a strong argument if it continues to be a natural person’s own crypto supply. | Derivatives, corporate activity, services to third parties and commercial structures are left out or require additional analysis |
| Mining | The subsequent sale of the crypto by the natural person may fit; The Opinion separately regulates VAT on the supply of computing power | Does not autonomously declare that every reward, service or mining company is 0% |
| Staking, lending or yield | No specific official rule enough to promise 0% | Bitcoin has no native staking; the return can be interest, service or other income |
| Wealth | There is no general annual tax on the wallet balance | Local tax on certain goods may rise in brackets for exempt income, potentially including a sale of BTC |
What exactly does Public Opinion 201 say?
Opinion 201 is a public decision, not a private opinion. Clarifies three questions:
- The supply of a cryptoasset – described in parentheses as exchange for national or foreign currency – is exempt from VAT.
- The income that a natural person obtains from supplying a crypto asset is exempt from income tax.
- The supply of computing power for mining has different VAT rules depending on where the recipient of the service is based.
The Tax Code exempts resident’s non-Georgian source income. As the cryptoasset lacks a physical form, location, deposit account and, typically, issuer, the Ministry concludes that the virtual operation has no Georgian source. It does not require a minimum term nor does it publish a sales threshold. This does not allow the criterion to be extended to futures, options, advice or interests, where the analyzed supply may not exist.
Selling, swaps and trading on your own account
The best supported case is the sale of own BTC for USD, EUR or GEL. A BTC/ETH swap is less clear: the income conclusion speaks of supply, but the scope and VAT conclusion identify the exchange for domestic or foreign currency.
The National Bank FAQ says that anyone who exclusively exchanges their own crypto as a client of a VASP, even P2P without benefiting third parties, does not need VASP registration. Operating a platform, custody, lending or managing for another person can be a regulated service. The own spot trader has good arguments, but bots, leverage, derivatives or multiple tokens justify a local written conclusion.
Payments: fiscally attractive does not mean legal tender money
The crypto asset is not legal tender. The official explanation prohibits payments with virtual assets except for exceptions necessary for VASP services. The conservative route is to convert with a licensed provider and pay in fiat – the exemption does not repeal that prohibition.
Mining, staking and returns
If the foreign recipient of hash power has no linked address or establishment in Georgia, the Opinion places the service outside of Georgian VAT; If it is established there, it is subject to VAT. This does not exempt a complete farm: initial reward, pool, electricity, employees and society require analysis. Bitcoin also has no native staking; Lending, custody or wrapped tokens generate income that the Opinion does not study.
Wealth and property tax
There is no general annual tax on a personal wallet. The assets of a natural person other than land are exempt when the family income of the previous year does not exceed GEL 40,000. Outside of this exemption, the property tax covers, among others, real estate, cars, yachts and aircraft. Their rates depend on family income: 0.05%-0.2% up to GEL 100,000 and 0.8%-1% from that threshold. Since the calculation includes tax-benefited income, an exempt sale could increase the property tax on the apartment or other asset; It must be verified what amount is computed.
Relevant changes between 2023 and 2026
The Opinion is from 2019 and was still valid at the time; what is new is compliance. Since 2023 there has been VASP registration and AML/CFT supervision; in 2024 a fines regime arrived; In 2025 the National Bank strengthened actions against unregistered; and from January 2026 the VASP must display the act that accredits its registration. The exemption remains, but the space for intermediation or informal cash-out is narrowed.
Tax residence
The Code considers a resident throughout the year to be anyone who remains 183 days or more in any continuous twelve-month period ending in that year. An immigration permit does not replace the test. Border movements, housing, consumption, insurance, account and tax certificate must be saved. Maintaining a home, family or economic center in the previous country can create double residence; Spain, for example, analyzes the entire calendar year.
Migratory routes
Visa-free stay
The official list allows citizens of Spain and other countries to remain a full year without visa. It does not grant permanent residence nor resolve the previous tax domicile.
Property and investment residence
The Public Services Development Agency publishes two routes:
- short-term residence permit for being the owner of a non-agricultural property with a market value greater than the equivalent of USD 150,000, accredited by an authorized appraiser;
- investment residence permit for a minimum investment of USD 300,000 or non-agricultural property with a value greater than USD 300,000.
Business investment requires annual volumes for five years; The real estate route to indefinite stay requires maintaining eligible property. There are also permits for work, business, family and technology. Showing a wallet does not replace investment, appraisal or documents.
Banking, cash-out and KYC
Georgia has VASP public registry. Confirms AML/CFT activities and supervision, not solvency or full protection.
Before a material sale:
- verify supplier and exact scope of your registration on the same day;
- ask the receiving bank in writing if it accepts the flow and what documents it requires;
- deliver exchange statements, hashes, dates, cost and wallet map;
- prove the source of the money with which the BTC were purchased;
- separate funds mined, purchased, donated or received for services;
- carry out a pilot operation without fractioning to avoid controls.
Self-custody raises the test. The seed phrase is never delivered; A message signature or other agreed procedure may be used.
Prudent Examples
Holder that sells directly to euros
Ana bought 3 BTC with banked savings in 2018. She actually moves, passes 183 days, opens an account and sells 1 BTC for EUR through a registered VASP. The assumption closely coincides with Opinion 201: income of the exempt natural person and conversion to fiat exempt from VAT. You still have to check that Spain or another previous country can no longer tax it.
Exempt sale and local apartment
Carla sells BTC and also owns an apartment in Tbilisi. Even if the sale is exempt from income, the income may affect your property tax bracket because the family calculation includes tax-benefited income. You must model both taxes before closing.
Checklist
- Confirm that the asset and operation fit into Opinion 201.
- Prefer converting BTC to fiat if you are looking for the clearest published assumption.
- Analyze swaps, derivatives, lending and rewards separately.
- Do not use BTC as an ordinary payment within Georgia.
- Separate your own investment from any service to third parties.
- Achieve and document 183 days under Georgian rule.
- Correctly break the residence of the previous country.
- Choose a migratory route compatible with the expected life.
- Verify VASP and pre-authorize the cash-out with the bank.
- Prepare cost, hashes, extracts and source of wealth.
- Check to see if the sale raises the property tax bracket.
- Obtain tax certificate and keep the file.
Main risks
- Extrapolate the Opinion: BTC/fiat is clear; swaps, derivatives and yield are not to the same extent.
- Confusing own sales with service: manage, custody, lend or transfer for third parties activates the VASP framework.
- Pay in BTC: The favorable tax regime does not override the regulatory prohibition.
- Banking friction: Supplier registration and tax exemption do not oblige the bank to accept the funds.
- Local property: An exempt income can raise the rate on real estate or other taxable assets.
- Incomplete residence: Passing 183 days does not automatically extinguish prior residency.
- Update: The current Georgian version prevails and should be revised when executing.
Conclusion
Georgia offers one of the few 0% crypto supported by a ruling that addresses income and VAT. For a natural person who sells own BTC to fiat after moving, the position is solid and does not depend on minimum term. Payments, derivatives, yield, mining as a service and activity for third parties are outside of that certainty. The defense demands 183 documented days and cash-out agreed with the bank and VASP.
