Living in Portugal with bitcoin in 2026: taxes, residency and practical guide

Ilustración editorial para la guía sobre bitcoin, impuestos y residencia en Portugal.

Portugal distinguishes private investment, investment income and business activity in its cryptoasset tax rules. For someone holding bitcoin as a personal investment, a sale may be excluded from personal income tax (IRS) after at least 365 days of ownership. The holding period alone does not settle the analysis.

Before selling, identify the asset being transferred, how it was acquired, the transactions that followed and the parties involved in payment. This guide organises those checks and the documents needed to support them.

This guide forms part of our comparison of countries for living with bitcoin wealth. To prepare for a move, see how to change tax residence before selling bitcoin.

If you are comparing destinations, our guide to living in Switzerland with bitcoin offers a comparison of private investment treatment and annual wealth taxes alongside the Portuguese conditions discussed here.

When Portugal is worth considering

This guide is particularly useful if you have held BTC for some time, can reconstruct its history and are considering genuinely living in Portugal. If you trade as a business, validate transactions or receive rewards, start by classifying that activity. Applying the private investor rules directly could produce the wrong calculation.

Organise the decision into three files: residence, the assets’ tax history and conversion into euros. A favourable answer in one does not replace the checks required in the others.

Bitcoin tax treatment for individuals

General guidance for Portuguese tax residents; the conditions for each treatment must be checked.
Situation Treatment What to check
Holding BTC without disposing of it Holding alone is not a sale that generates a capital gain for IRS. Distinguish ownership from rewards, business activity and tax departure.
Private sale after at least 365 days Exclusion of gains and losses for cryptoassets covered by the rule. The asset, holding period and territorial conditions.
Private sale before 365 days Generally 28% on the taxable positive balance, with an option for residents to aggregate it with other income. Acquisition cost, allowable expenses and eligible losses.
Exchange for another cryptoasset Taxation may be deferred while preserving the acquisition cost. Deferral conditions and the sequence of transactions.
Payment for goods or services May realise a gain; it is not a crypto-for-crypto exchange. Consideration received and a documented valuation.
Business or professional activity Category B. The simplified regime has different coefficients for crypto operations and mining. A coefficient used to calculate the taxable base is not a tax rate.
Staking, lending or other remuneration Potentially category E or B; rewards paid in cryptoassets have a specific rule. The contract, activity and form of payment.

How the 365-day exclusion works

Article 10(1)(k) of the Portuguese Personal Income Tax Code (CIRS) covers disposals of cryptoassets that are not securities and do not fall within other income categories. Paragraph 22 excludes both gains and losses on assets held for at least 365 days. Unique, non-fungible assets fall outside this particular tax definition. Do not automatically apply the result for directly held BTC to an ETF, derivative or token carrying different rights.

Ownership before 2023 also counts towards the holding period. The Portuguese Tax and Customs Authority (AT) directs excluded transactions to Annex G1: a gain being untaxed does not remove the reporting requirement. Keep dates, amounts and supporting documents. When filing IRS, check the instructions for the relevant year and the annex appropriate to the income’s source.

The territorial condition matters. The tax residence of the parties must satisfy the statutory conditions involving the EU, EEA or a jurisdiction with an applicable treaty or information exchange agreement. An exchange’s trading name does not necessarily identify the person or entity owing the income. AT binding ruling 29052 expressly retains this condition.

Taxable sales at 28% and calculating the gain

The general rate on the taxable positive balance of these capital gains is 28%. Residents may elect to include it in their general income, known as englobamento, so both calculations should be compared. Mandatory aggregation of certain sales within 365 days for taxpayers reaching the highest income band concerns securities under Article 10(1)(b). It should not simply be extended to BTC covered by point (k).

The calculation starts with the disposal proceeds and tax acquisition cost, allowing necessary expenses actually incurred where the law permits them. Distinguish eligible losses from excluded losses and review counterparty restrictions.

FIFO: acquisition order and separate service providers

FIFO treats the cryptoassets acquired first as those disposed of first. Where assets are deposited with different institutions or service providers, Article 43 applies that rule separately by reference to each entity.

The wording does not expressly establish a separate FIFO pool for every self-custody address. Creating another wallet should therefore not become an arbitrary way to choose the lot being sold. Reconcile incoming and outgoing transfers and movements between your own wallets. Where the history combines custodians and self-custody, document the approach taken and have it reviewed.

Swaps, stablecoins and payments

Where the holding-period exclusion does not apply, an exchange in which the consideration is another cryptoasset may avoid taxation at that point: the asset received retains the acquisition cost of the asset surrendered. Article 10(23) contains this rule, alongside the territorial conditions in paragraph 24. Carrying forward the cost does not establish that every sequence of exchanges automatically preserves the original acquisition date.

There is a useful interpretation for a limited situation. In binding ruling 28969, dated 31 October 2025, the AT considered a technical conversion into USDC immediately followed by a sale for euros because no direct trading pair existed. On the facts described, it accepted the exclusion after the original asset’s minimum holding period. That answer does not, by itself, resolve successive exchanges, prolonged stablecoin investment or different DeFi strategies.

Using crypto to pay for a car, property or service may realise the gain: the consideration is no longer another cryptoasset. Keep the invoice or contract and the transaction valuation as well.

Trading, category B and mining

Issuing cryptoassets, mining and validating transactions through consensus mechanisms are listed as commercial activities in Article 4(1)(o).

For buying and selling, the AT examines regularity, purpose and the economic significance of the activity. Its ruling does not set a magic number of transactions separating investment from business. Where category B applies, it takes precedence.

Under the simplified regime, the general coefficient for these operations is 0.15 and the mining coefficient is 0.95. The 0.95 coefficient does not automatically extend to every form of validation. For €100,000 of revenue to which each coefficient applies, the initial taxable base would be €15,000 or €95,000, respectively. Those figures are not the tax due. The resulting base is taxed under the general rules.

The simplified regime uses a threshold of €200,000 in gross income from the preceding period, subject to entry, continuation and accounting-option rules. Recognition of crypto income and the effects of ceasing activity or leaving tax residence have their own provisions. The exclusion for a private portfolio should not be imported into this regime.

Staking, lending and other rewards

Remuneration from cryptoasset operations may constitute investment income. Where it takes the form of cryptoassets, Article 5(11) provides for taxation as a capital gain when the received assets are disposed of. First establish whether the income instead belongs to a business activity. The commercial label “staking” does not replace an examination of the contract and what you actually do.

For taxable investment income received in money, the general rate is 28%, with an aggregation option; special jurisdiction-related rules also exist. The waiver of withholding for these payments does not mean exemption from tax. For payments in tokens, also check the territorial conditions.

Portuguese tax residence and the country of departure

An individual may be tax resident by spending more than 183 days, consecutively or otherwise, in any twelve-month period beginning or ending in the relevant year. Residence can also arise with fewer days where the person has a home in circumstances indicating a present intention to keep and occupy it as a habitual residence. The start date can extend back to the first day of the period of presence. Waiting until day 184 may therefore produce the wrong timeline.

Residents are subject to IRS on worldwide income, subject to the rules for each income type and part-year residence. Prepare the analysis of the previous country too: days, available housing, family, work and the applicable treaty. A Portuguese tax number or immigration permit does not replace this review.

Revisit the calculation before leaving Portugal. Loss of residence is treated as a disposal of cryptoassets covered by Article 10(1)(k). The valuation rule compares their market value on departure with the legally prescribed acquisition cost. Its interaction with applicable exclusions must be examined.

Immigration routes: free movement and the D7

For citizens of the EU, EEA and Switzerland, registration at the local Câmara Municipal is required when a stay exceeds three months, within the following thirty days. The relevant conditions must be met, such as professional activity or sufficient resources and health coverage under the applicable rules.

For third-country nationals, the visa commonly called the D7 covers pensioners and people living from their own income. Requirements include accommodation, means of subsistence, insurance and criminal-record documentation, among other matters. Owning bitcoin does not establish that the visa will be granted. If your livelihood depends on selling BTC, confirm with the consulate what evidence is required for that situation.

If you intend to work or start a business, examine the permit appropriate to that activity. The immigration route and tax classification should reflect the same facts.

NHR, IFICI and legislative changes

The former NHR/RNH regime was repealed from 1 January 2024, with protected rights and transitional cases. It is not a general option for someone beginning residence in 2026.

IFICI requires, among other conditions, not having been resident during the previous five years and carrying out eligible professions or activities. Holding a bitcoin portfolio does not qualify a person for it or make all income exempt.

One clarification when reading older material: Decree-Law 97/2026 renumbered Article 10. The crypto rules that many guides cite as paragraphs 19–22 now appear in paragraphs 22–25. Renumbering is not a new crypto exemption.

Housing, banking and conversion into euros

Keep the housing budget separate from the BTC calculation. AIMI applies to certain residential property and building land, not to a wallet balance. Buying a home also requires reviewing acquisition and ownership taxes.

When choosing a provider, check its legal entity, permitted services and current registration. The maximum EU MiCA transitional period ended on 1 July 2026. A historical list of national registrations is insufficient to establish current authorisation. Check the ESMA MiCA register and the scope of the provider’s entitlement, including the routes for certain financial institutions under Articles 59 and 60.

Before instructing a substantial transfer, ask the bank what documentation it needs to examine the source of funds. Present the chain from acquisition to sale, including exchanges and intermediate custodians. Tax calculations and banking reviews are separate checks: this guide does not guarantee acceptance of a transfer.

Cautious examples

BTC acquired in 2019

Ana retains records of purchases made in 2019 and is considering a sale after moving. Her file must establish ownership, private investment status, residence and the transaction’s conditions. The holding period is one part of the analysis, not automatic permission. Activity and jurisdiction must also be examined.

A private sale before 365 days

Bruno buys for €60,000 and sells for €90,000 eight months later. If the whole €30,000 difference is taxable at the general rate, with no expenses, losses or aggregation election, the illustrative calculation is €30,000 × 28% = €8,400. Changing any of those assumptions may change the result.

A swap followed by a property purchase

Carla exchanges BTC with a tax cost of €20,000 for ETH. If deferral applies, she must preserve that cost. Before using ETH to pay for property, she reconstructs the dates, payment value and final disposal conditions. The exchange’s displayed value on the swap date should not replace the carried-forward cost without a legal basis.

The documentary file before moving or selling

This is a practical organisational checklist. It does not replace documents or forms required by an authority.

  1. Residence: a presence calendar, actual accommodation, moving date and analysis of the country of departure.
  2. Origin: acquisition records, statements, contracts and how each asset was obtained.
  3. Traceability: movements between custodians and wallets, transaction identifiers and reconciliation of balances.
  4. Tax: lot calculations, cost, holding periods, swaps, fees and separation from professional activity.
  5. Parties: the contracting entity, person owing the income and relevant tax residence.
  6. Sale: the planned transaction, valuation, execution records and documents requested by the bank.
  7. Reporting and subsequent departure: the relevant annexes, filing receipts and a review before changing residence again.

If years of transaction history are missing, reconstructing them is usually more useful than starting with the sale date. Keep exportable records. A screenshot of the current balance says little about its origin.

Frequently asked questions

Must I wait 365 days after arriving in Portugal?

The rule concerns ownership of the asset, not a compulsory waiting period after moving. Analyse the start of residence and the conditions of the sale separately.

Is receiving a stablecoin equivalent to receiving euros?

They should not automatically be treated alike. Examine the asset and the transaction. The interpretation concerning an immediate technical conversion discussed above does not settle every chain of swaps.

Does the exclusion allow me to omit the sale from IRS?

No. The AT provides for reporting excluded transactions. Your file should explain why that treatment was applied.

Does the D7 guarantee tax residence or the bank’s acceptance?

These are different analyses. The visa has its own requirements, tax residence follows the CIRS rules, and the bank examines the transaction and the documents you provide.

General information, not individual advice. A significant move or sale requires an assessment of the facts and the rules in Portugal and the country of departure.
