Living in Cyprus with bitcoin: new 8% tax, residency and guide 2026

Ilustración editorial para la guía sobre bitcoin, el impuesto del 8 % y la residencia en Chipre.

This guide is part of the comparison of the 10 best countries to live with assets in bitcoin. Before executing a sale, it is also advisable to review how to change tax residence before selling bitcoin.

Quick verdict

Cyprus should no longer be promoted as a destination where bitcoin capital gains “may not be taxed.” Since January 1, 2026, there has been an express rule: the benefit obtained by any person by having crypto assets supports a 8% autonomous tax.

It’s not zero, but it buys something valuable: certainty. The law defines as provision the sale, donation, crypto-to-crypto exchange and use as a means of payment. The holder knows the type before moving; A trader also has a much more predictable framework than in countries that discuss whether their profit is capital or business. In exchange, losses only offset crypto gains from the same year and assets acquired through mining are outside the special regime.

Cyprus occupies tenth place because it combines a low rate, EU membership, no general wealth tax and residence routes of 183 or 60 days. It is an option for those who prefer to pay a defensible 8% rather than chase an uncertain 0%.

Who it fits — and who it doesn’t

You may fit if:

  • an explicit legal rule and a known maximum cost for the disposal of BTC are desired;
  • Several sales or exchanges are going to be made and the certainty weighs more than 0%;
  • residing in the EU, the Mediterranean climate and regional connectivity are valued;
  • activity, employment or actual management position can be created to comply with the 60-day tax rule, or spend more than 183 days;
  • The capital gains are large and there is sufficient liquidity to pay the tax.

It fits worse if:

  • There are mined BTC, the treatment of which is outside 8%;
  • There are large historical losses that they want to carry over to later years;
  • It is planned to pay everyday expenses with crypto without registering each provision;
  • it is trusted that the regime non-dom exonerate bitcoin: it is mainly designed for dividends and interest, it does not clear the crypto item;
  • 0% pure is sought and the German or Portuguese deadline can be safely met.

Bitcoin tax table in Cyprus

Situation Treatment from 1-1-2026
Hold BTC It does not generate the 8% tax on its own; there is no general wealth tax
Sale for euros or dollars 8% on the profit of the disposal
Swap BTC for another crypto or stablecoin Disposal included; 8% on profit
Payment for a good or service with BTC Disposal included; 8% on profit
BTC gift The definition includes donation; can generate tax even without receiving cash
Own account trading The disposals fall within the 8% framework, unless another nature or exclusion requires an ordinary regime
BTC obtained through mining Expressly excluded from article 20E; ordinary rules apply
Staking, lending or yield Without sufficient official criteria: analyze reward and subsequent sale separately
Crypto losses Only against crypto earnings from the same person and the same year; no carry-forward

The reform that ended uncertainty

Until 2025, it was common to find three incompatible answers about Cyprus: untaxed capital gains, business income subject to ordinary rates or profits outside the Cypriot capital tax. That insecurity ended with Law 244(I)/2025.

The new article 20E of the Income Tax Law From January 1, 2026, 8% applies to the benefit of any person from the disposal of cryptoassets. The wording is deliberately broad: it includes sale, donation, exchange for another crypto asset and use as a means of payment.

The rule is not limited to BTC nor does it require a holding period. Nor does it distinguish, at its core, an investment capital gain from a frequent sequence of dispositions. This explains why Cyprus may be more attractive to an active trader than Germany, Portugal, Switzerland or Malta, where professionalism leads to higher ordinary rates.

But 8% does not cover everything that happens in the sector. Fees for advice, custody or management; salaries collected in crypto; and services provided to third parties continue to require analysis of ordinary income, VAT, social security and licenses. The article taxes the benefit of disposing of the asset, it does not transform any digital business into crypto income at 8%.

How profit is determined

The law speaks of the benefit of the provision. In practice, it must be possible to demonstrate at least:

  • units sold;
  • attributable acquisition cost;
  • market value of what was received;
  • date and time;
  • directly linked commissions;
  • identification of movements between own wallets;
  • Consistently applied lot allocation method.

For a large portfolio it is not advisable to improvise the method after selling. The administration can dictate development rules and forms; The taxpayer must check the version applicable to the year of the operation.

Sales example

A person acquires BTC for 200,000 euros and, already as a Cypriot tax resident and not a resident in his previous country, sells the same units for 1,200,000 euros. Ignoring commissions and adjustments, the profit is 1,000,000 euros and the special tax would be 80,000 euros.

The same person cannot offset a stock market loss of 100,000 euros against that crypto gain. If you suffer a crypto loss in December of the same year, you could compensate it within the limits of the article; If the loss comes the following January, you can’t roll it back or carry it forward.

The example is not an actual settlement. The cost, commissions, residency and exact timing must be validated before trading.

Exchanges, payments and donations: the risk of paying taxes without euros

Cyprus avoids one of the most common doubts by expressly mentioning crypto-to-crypto exchange. Exchanging BTC for USDC, ether or another token is a provision even if it does not involve fiat money. The benefit is calculated with the value of what was received.

The same thing happens when paying for a car, a home or services. Each use can materialize part of the added value. Maintaining a book by units and market value is a must if using BTC in daily life.

The inclusion of the gift deserves special attention. Donating BTC to a child or third party can generate an 8% fee without the donor receiving liquidity to pay it. In addition, the recipient’s basis of acquisition, family relationships and any inheritance or other State rules must be reviewed. Moving BTC between two wallets of the same holder is not, in and of itself, a gift; The control test avoids this confusion.

Professional trading

The 8% rate makes Cyprus unusually predictable for self-trading. Even so, three layers must be separated:

  1. Disposition of own portfolio: falls into article 20E.
  2. Services to clients or management of external funds: income from an activity and possible financial regulation.
  3. Operation through a company: the legal entity and payments to the owner require their own calculation; individual treatment should not be automatically transferred.

A resident trader may also be required to keep books, issue documentation, make provisional payments or audit accounts based on billing. The official portal Business in Cyprus explains from 2026 the registration obligations and ordinary rates, which reach 35% above 72,000 euros of taxable income.

For someone with repeat business, paying 8% on the disposition profit may be better than arguing for years whether it was an investment. For a single old BTC holder, Germany, Portugal or the UAE still offer greater savings if all their conditions are met.

Mining and staking

Article 20E expressly excludes crypto assets acquired through mining. This prevents us from stating that selling mined BTC is always taxed at 8%. The reward and its sale must be analyzed under ordinary rules, potentially as a business activity with personal fees of up to 35%, contributions and VAT depending on the facts.

It is advisable to separate the BTC purchased from the mined from day one. Mixing them in a single wallet without a reliable ledger can make it very difficult to assign the correct treatment.

Bitcoin does not have native staking. A performance called “BTC staking” is usually lending, wrapped BTC, DeFi or custodial service. No official Cypriot interpretation has been found that generally resolves:

  • when the reward is taxed;
  • if there is provision of services;
  • what is the cost of the token received;
  • and if its subsequent disposal enters 8%.

The prudent position is to value the reward as possible ordinary income upon receipt and analyze the subsequent sale separately, requesting judgment for significant amounts.

Tax residence: 183 days or the rule of 60

Cyprus considers a resident to be anyone who stays more than 183 days during the calendar year. It also offers a 60-day rule, as long as the required links are met simultaneously.

Since 2026, the old domestic condition of not being a tax resident in any other country has been eliminated. Among other requirements, the following are maintained:

  • spend at least 60 days in Cyprus;
  • not stay more than 183 days in any other State;
  • maintain a permanent home, owned or rented, in Cyprus;
  • exercise activity, be employed or hold a position in a Cypriot resident company during the year, with the legal conditions.

The reform is included in the official material of the tax reform of 2026. The deletion facilitates domestic entry, but does not resolve double residence: if Spain or another country also considers the taxpayer a resident, the agreement and its housing criteria, center of interests and habitual presence govern.

For a sale of millions, the conservative route is to spend more than 183 days, move family and vital center and obtain a tax certificate. The 60 day rule may be valid, but it requires more proof and is not a paper residency.

Non-dom regime: useful, but not to erase the 8%

New residents who are not considered domiciled in Cyprus can obtain benefits on dividends and interest over the special defense contribution for a long period. The 2026 reform maintains the system non-dom and adjusts when prolonged residence creates presumed domicile.

That advantage is relevant for a global financial portfolio, but does not replace Article 20E. A BTC disposition made by a Cypriot resident follows its specific rate of 8%. Mixing both regimes in advertising is one of the most frequent sources of incorrect promises.

Migratory routes

EU citizens can settle under free movement, registering their residence where applicable and proving work, activity or sufficient resources and health coverage. For third countries there are, among others, two relevant routes:

  • Digital Nomad Visa: requires remote work for foreign employers or clients and monthly net income of at least 3,500 euros. It is not a rentier’s permit for someone who only sells his portfolio.
  • Permanent residence by investment: qualified investment of at least 300,000 euros in new housing, another property, capital of a Cypriot company with presence or certain fund holdings, plus secure annual income of at least 50,000 euros for the applicant, increased by family members.

The Migration Department publishes investor residency requirements, including foreign origin of funds, insurance, background and maintenance of the investment. Direct BTC does not replace the required investment asset; Normally you will have to prove origin and transfer funds through a financial institution.

Nor does permanent residence as an investor simply grant freedom for any employment. It must match the activity that will be used for the 60-day tax rule.

Banking, suppliers and origin of funds

Cyprus is within MiCA and the European anti-money laundering regime. A bank or supplier can accept the taxpayer and still temporarily freeze an extraordinary income until the review is completed.

The file should include:

  • bank statements of initial purchases;
  • exchange histories and commission receipts;
  • on-chain addresses and transactions;
  • explanation of movements between self-custody and platforms;
  • tax returns for the years of acquisition and previous residence;
  • proof of cost and source of funds;
  • chain analysis if mixers, P2P or defunct platforms were used.

The seed is never communicated. Control of a wallet can be proven by signature or an agreed transaction.

Law 38(I)/2026 incorporated DAC8 with effect from January 1, 2026. The official announcement from the Tax Department sets the first communication in 2027, until June 30, on operations in 2026. Transparency does not raise the rate; makes it essential to declare correctly.

Relevant changes between 2023 and 2026

  • Until 2025 there was no sufficiently clear crypto tax classification.
  • Law 244(I)/2025 created article 20E, applicable from January 1, 2026.
  • The reform expanded the ordinary exempt personal minimum to 22,000 euros and changed sections, relevant for mining and services, outside of 8%.
  • Since 2026, the 60-day residency rule no longer requires not being a tax resident in another country under the domestic rule; agreements remain essential.
  • Law 38(I)/2026 implemented DAC8 and the 2026 operations report.

Checklist before selling

  1. Separate BTC purchased, received for work, mined and from returns.
  2. Rebuild cost, units and wallets per batch.
  3. Leave the residence of the previous country before selling, exchanging or paying.
  4. Choose and really follow the Cypriot rule of 183 or 60 days.
  5. Obtain tax number and certificate.
  6. Confirm if the operation falls entirely within article 20E.
  7. Schedule profits and losses within the same year when lawful and economically sensible.
  8. Reserve liquidity for 8%, especially in gifts or exchanges.
  9. Prevalidate bank and supplier with the source of funds file.
  10. Present declarations and DAC8 correctly even if the supplier also reports.

Main risks

  • sell before completing the tax exit from the previous country;
  • treating a stablecoin as a simple non-taxable “pause”;
  • donate BTC without setting aside cash for tax;
  • trying to carry over losses to subsequent years;
  • apply 8% to mined BTC without confirmation;
  • consider staking as ordinary selling without analyzing the reward;
  • create a fictitious corporate address just to serve 60 days;
  • believe that non-dom eliminates crypto tax;
  • Do not declare because the fee seems simple.

Conclusion

Cyprus does not win the lowest rate contest; Earn points for clearly stating how much it costs. For one million euros of eligible profit, the reference is 80,000 euros, not an open discussion between 0% and 35%. That predictability can justify the cost.

The country is especially interesting for self-activity with multiple provisions and for those who want European residence. It is less efficient for old BTC that can be legally sold at 0% in Germany, Portugal, UAE or Georgia, and requires extra care with mining, staking and losses. A coordinated exit and entry opinion is still necessary before executing the first swap.
