Germany may be one of the best European destinations for a person who bought bitcoin as a private investment and has held it for more than a year. In this case, the sale is normally excluded from German income tax. There is also no general wealth tax that will be collected in 2026.
The advantage does not cover everything related to crypto. A sale within the first year, a payment, a swap, staking, mining or organized trading can produce taxable income. Dates and separation between private assets and business are decisive.
This guide is part of the comparison of the 10 best countries to live with assets in bitcoin. Before executing a sale, it is also advisable to review how to change tax residence before selling bitcoin.
Verdict
Germany is especially attractive for someone who has held BTC for more than a year and genuinely moves before selling. Its strength is a relatively simple legal rule, supported by the Federal Tax Court and developed by a circular from the Ministry of Finance of March 2025.
For an intensive trader or for those who need to sell newly acquired BTC, Germany loses much of its appeal: income can be subject to the personal scale, the maximum rate of which reaches 45%, with a solidarity surcharge and church tax when applicable. Nor is it the easiest immigration route for a third-country national who lives exclusively off his assets.
Who is it suitable for?
- Individual investor who keeps BTC for more than a year and makes specific sales.
- Citizen of the EU, EEA or Switzerland who can settle without first obtaining a visa.
- Person seeking legal certainty, European banking infrastructure and absence of general wealth tax.
- Taxpayer capable of demonstrating dates, cost, own wallets and each historical exchange.
- Family that wants to move housing and living center to Germany, not just obtain an address.
Who is it not suitable for?
- High-frequency trader, with leverage, professional organization or income intended to regularly finance your life.
- Person who intends to exchange BTC for stablecoins just before turning one year old: that swap is a provision.
- Miner, validator or lender who assumes that all crypto income will inherit the exemption from the sale of BTC.
- Non-EU national without employment, real business, family ties or other immigration basis.
- Who already sold while still a resident of their previous country.
Bitcoin tax table for a natural person
| Situation | Prudent treatment as of August 9, 2026 | Practical key |
|---|---|---|
| Hold BTC | Does not generate income by mere possession | There is no general wealth tax currently collected |
| Private sale outside the period of one year | Profit normally not subject to article 23 EStG | You must prove acquisition, ownership and date of disposal |
| Private sale within the year | Taxable income at personal rate; The set of private profits is exempt only if it is less than €1,000 in the year | €1,000 is a Freigrenze: upon reaching the limit, the first €1,000 is not deducted |
| Swap or payment with BTC | It is a disposal: profit is calculated and, for what is received, a new period begins | BTC for ETH, stablecoin, euros, car or service is not fiscally neutral |
| Professional trading | It can be a business activity and be taxed as ordinary income | Frequency alone does not decide; Organisation, intention, financing and conduct in the market matter |
| Mining | Taxable reward; private as other income or business according to the facts | Equipment, continuity, scale and profit orientation weigh in the classification |
| Staking, lending and yield | The passive reward is usually another return at market value when the right is received or arises; an organized activity can be business | Bitcoin has no native staking; the actual product contract must be read |
| Wealth | There is no general tax on net worth | Real estate, inheritances, donations and businesses can generate other taxes |
The rule of the year, without slogans
The Article 23 of the German Income Tax Act subjects private sales of other assets to tax when the interval between acquisition and disposal does not exceed one year. The administration and courts include cryptocurrencies in this category.
In practice, each unit sold is compared with its acquisition. If the transaction falls outside the one-year window, the private gain is not included in the income tax. The owner is not required to be German during this entire period: the time of ownership prior to the move counts, as long as it can be proven.
From 2024, taxable private profits are exempt if their annual sum is less than €1,000. It is a franchise: upon reaching the threshold, the entire profit goes into the base; €1,000 is not subtracted.
The circular of the Federal Ministry of Finance dated March 6, 2025 confirms that both the sale for fiat money and the exchange for another crypto asset or the use to acquire goods and services are provisions. The market value of what was received determines the transmission price and the new tax cost.
Example: if someone exchanges 0.5 BTC for ETH valued at €30,000 after eight months, they have disposed of the BTC. ETH is purchased for €30,000 and begins its own term.
Does staking or lending extend the term to ten years?
No. The 2025 circular maintains the criterion that the term of a unit used for staking or lending is not extended to ten years. The subsequent private sale may be excluded from article 23 after the year has elapsed.
That does not make the reward exempt. Passive staking, lending and comparable activities may generate other returns under Article 22. The reward is normally valued when it is received or when the taxpayer acquires an economically available right. If the annual total of this type of income does not reach €256, you can operate the specific franchise; when reached, it does not function as a partial deduction.
In Bitcoin, “staking” is usually lending, custodial deposit, DeFi or exposure to a third party. The income, the future sale of the reward and the possible entrepreneurial character must be separated.
Trading, mining and business activity
The sale of a large portfolio does not automatically become a business due to its amount. There is also no magic number of operations that guarantees private status. The administration applies by analogy factors developed for securities and currency traders: organization, professional knowledge, frequency and volume, financing, acting on behalf of third parties and nature of market participation.
When the activity is business, the private rule of the year does not apply. Profits enter ordinary income and may arise in accounting and municipal tax on economic activities. A zero rate should not be assumed.
Mining and forging are also classified on a case-by-case basis. An occasional and non-commercial participation can produce other returns; A continuous installation, with equipment, energy, processes and profit purpose, aims at business. The reward is recognized as income and the coins received acquire a tax cost that will be relevant in their future sale.
What changed between 2023 and 2026
- February 14, 2023: The Bundesfinanzhof confirmed in case IX R 3/22 that Bitcoin, Ether and Monero are assets and that their private sale within the year can be taxed. The sentence appears in the official tax manual.
- From 2024: The annual deductible of article 23 went from €600 to €1,000.
- March 6, 2025: A new circular replaced the 2022 one, specifying valuation, claiming, staking, mining and documentation. There is a official english translation.
- 2026: the substantive rule of the year remains in force. The European trend, however, is towards more platform information and traceability, not towards fiscal anonymity.
German tax residence
A person is subject to his or her worldwide income if he or she has domicile or habitual residence in Germany. Domicile does not require ownership: it is enough to have a home in circumstances that indicate that it will be maintained and used. Habitual residence is normally presumed with a continuous stay of more than six months, although brief absences do not necessarily interrupt the calculation.
The rules are in the articles 8 y 9 of the Abgabenordnung, also summarized in the federal services portal.
An available home can create residency before day 183. Registering in Germany also does not eliminate previous residency. If two countries claim residence, the agreement examines housing, center of vital interests, habitual stay and nationality.
Country of departure remains part of the calculation
The German exemption only answers the German question. Before selling, housing, presence, family, activity and other relevant links from the previous country must be closed in a manner compatible with its law and with the agreement. It is also necessary to review exit taxes, anti-abuse rules or special regimes that companies, funds or participations may apply; Owning BTC directly should not be confused with owning it through an entity.
Migratory routes
EU, EEA and Swiss citizens can enter and reside under free movement rules, with local registration and health insurance where applicable.
For third-country nationals, Germany does not offer a “bitcoin visa” or a general passive wealth visa. The usual routes are qualified employment, Blue Card, studies, regrouping or self-employed activity. The permit for self-employment requires, among other elements, economic interest or regional need, expected positive effects and assured financing; For applicants over 45 years of age, retirement provision is reviewed. The official portal Make it in Germany explains the requirements.
Creating a fictitious company just to obtain residency can destroy the profile of a passive investor. The migratory route must correspond to a real activity.
Banking, cash-out and KYC
Germany has regulated banks and crypto providers, but no bank guarantees accepting a million-dollar transfer. The entity will apply identity controls, origin of assets and specific origin of funds. BaFin’s guidance on the Money Laundering Act requires entities to take a risk-based approach: official guidelines for credit institutions.
Before the cash-out it is advisable to prepare:
- bank statements of the original purchases;
- complete, downloadable exchange histories;
- addresses, hashes and a map of transfers between own wallets;
- control test without sharing seeds or keys;
- tax returns and justification of salary, donation, inheritance or mining;
- batch calculation, values in euros and prior confirmation from bank and authorized platform.
A large sale should be announced in advance. Splitting deposits to avoid controls is counterproductive. Nor does the acceptance of a supplier in another EU country oblige the German bank to consider its file sufficient.
Prudent Examples
Old BTC Sale
Laura acquired 3 BTC in 2020 and actually moves to Germany in February 2026. She sells 1 BTC in October. If you prove the purchase, maintain private assets and are no longer a previous resident, the gain is outside article 23.
Sale and swap within the year
Daniel buys 1 BTC for €60,000 in March and exchanges it for ETH in December when it is worth €90,000. The €30,000 gain is a private disposal within the year and is not protected by the €1,000 threshold. The fact of not having received euros does not avoid the tax.
Yield reward and subsequent sale
Marta receives tokens valued at €5,000 for a product called “BTC staking.” You must analyze them as income upon receipt. Its subsequent sale is a different taxable event.
Checklist before moving or selling
- Obtain coordinated advice in Germany and in the country of departure.
- Identify the exact date of each acquisition and each historical swap.
- Separate asset wallets from any trading or business activity.
- Confirm that the asset is straight BTC and not a wrapped security, fund, or token.
- Define a realistic immigration route before assuming tax residency.
- Document housing, registration, insurance and days of presence.
- Resolve the previous residence and the agreement before selling.
- Separately calculate sales, payments, rewards and mining.
- Prevalidate exchange, bank and fund origin file.
- Do not make a “temporary” swap before the end of one year without calculating its effect.
- Save records and ratings in a reproducible format.
- Review the law again immediately before a material transaction.
Main risks
- Confuse possession with all crypto activity: Only mere possession does not generate income.
- Reset the term using a swap: The exchange for stablecoin is also available.
- Professional reclassification: an organized operation loses the private exemption.
- Double residence: Renting in Germany is not enough to break previous ties.
- Lack of traceability: Without proven cost, a favorable tax position can be difficult to defend.
- Inadequate visa: There is no automatic residency for demonstrating wealth in BTC.
- Mislabeled products: “BTC staking” can be a loan, derivative or service.
Conclusion
Germany offers one of the most powerful and understandable rules in Europe: a true private gain on BTC can become tax-free after one year, with no general annual wealth tax. That advantage requires discipline. Each payment or exchange is a disposition, the rewards are taxed separately and a professional activity leaves the private regime.
Solid planning isn’t about showing up and selling the next day. It consists of rebuilding lots, confirming that the deadline has passed, executing a real tax move, resolving the country of departure and agreeing with the bank and platform how the money will be justified.
